General terms and conditions


Part 1. GENERAL

Article 1 - Scope

The General Consumer Terms and Conditions apply to all our activities.

Article 2 - Assignment

An order as referred to on our website is issued if the consumer has provided the order digitally or in another written way to Homecrew and has paid the costs to Homecrew. This certainly includes filling out the registration form on the broker's website. By giving the order, the consumer declares that he is authorized to deliver the property. If the consumer acts on behalf of third parties, he will make the written power of attorney available to Homecrew. The consumer is obliged to provide Homecrew with a copy of his identity document immediately after giving the order.

Article 3 - Liability and assignment

Homecrew is never liable for an amount that exceeds the merit described in the assignment. If this leads to an exceptionally unreasonable individual case, Homecrew will never be liable for more than the liability insurance coverage. If it does not cover or does not fully cover, this exception rule expires.

Article 4 - Duration of the assignment

In principle, the assignment is for a maximum period of 6 months. The order can be terminated by the consumer. There is then no right to a refund of funds already paid or not to pay services/deliveries already provided. Homecrew can terminate or suspend the order after 6 months without refunding any funds already paid.

Article 5 - End of assignment

If the order is withdrawn, the consumer may owe Homecrew additional compensation. This may include, for example being for; conducting viewings or an open house, issuing advice, correspondence with candidates and negotiations. There are no reasons to moderate this compensation, including death, bankruptcy, suspension of payments, etc.

Article 6 - Consumer obligations

The consumer is obliged to complete the digital application form as completely as possible. The consumer himself is liable for providing accurate data. If the consumer provides incorrect information to a candidate orally or in writing, whether consciously or not, the consumer indemnifies the broker from any liability. The consumer is obliged to report all relevant information regarding the property to Homecrew and the buyer or tenant. The consumer is obliged to check all Homecrew information that becomes available to third parties for accuracy. Any errors in these statements are at the risk and expense of the consumer, unless it concerns statements concerning Homecrew's organization.

Article 7 - Payments

Payments must be made before the order is actually executed. For example, the property will therefore only be advertised on www.funda.nl and/or www.pararius.nl once payment has been made. The ads are valid for 3 months. Failure to publicize for this reason does not constitute a ground for breach of contract or compensation otherwise. The obligation to pay in full remains. If Homecrew removes all or part of the property from an internet site due to non-payment of a (partial) service, this is not a breach of contract and this cannot result in compensation in any way. If Homecrew has to incur costs to collect payments, these costs will be borne entirely by the consumer.

Part 2. SERVICES

Article 1 - Description of assignment

Homecrew's activities include the following: Based on the consumer's data, an indication of the home value and the asking price will be provided in writing or orally. The consumer determines the asking price himself; Processing this data in the Funda and/or Pararius system; Mentioning the information provided by the consumer with regard to the sale or rental of the property on Funda, Pararius and any social media; Passing on the data provided by the consumer to interested parties insofar as they have reported directly to Homecrew; Acting as an intermediary for viewings; Providing advice by email or phone regarding sales/rentals procedure; Conducting negotiations on behalf of the consumer; Concluding a purchase/rent agreement if and insofar as there is oral or written consent from the consumer; Passing on the most important details of buyer/tenant and seller/landlord and any special conditions to the notary. There is therefore no full Service Order, but a number of partial services. Other items are not part of the assignment as given to Homecrew. If the consumer wishes to make use of other services and/or deliveries, additional costs will be charged for this. These are listed on the Homecrew website. The following items are not part of Homecrew's standard activities: viewing the property, pre-delivery of the property, attendance at the signing of the rental agreement or deed of sale, attendance at the notary when passing the deed.If the consumer has contractual (for example as described in the title deed) or otherwise, obligations towards third parties, including by providing a purchase option or preferential right to purchase, then the consumer must pay these obligations himself wrapping, preferably before the property is offered via the broker. If and insofar as a consumer decides to independently take over activities that could fall within Homecrew's activities, this is allowed. Of course, these independently developed activities and their possible consequences are entirely at the expense of the consumer himself. Performing (part of) Homecrew's services independently or without consultation with Homecrew has no consequences for the costs paid or payable.

Article 2 - Publicity

By paying the order, the consumer agrees that Homecrew publishes the property or uses it for advertising purposes. Any damage caused by this to the consumer does not entitle the consumer to any compensation. If websites other than www.funda.nl and www.pararius.nl take over the information about the property, this will be done without Homecrew's permission. Homecrew is not liable for any damage resulting from taking over and/or publishing the property details. Even if Homecrew agrees to publish the information, it is not liable for any damage to the consumer.

Article 3 - Commission and costs

Unless otherwise expressly agreed, commission amounts to as stated in the application form. All additional services and deliveries from Homecrew (and costs) are listed on the website or otherwise announced. If the order is terminated, the client is not entitled to a refund under any circumstances. If, for whatever reason, Homecrew does not fully or partially provide certain parts of its service, this does not lead to a reduction in commission or costs.
